Terms of Service

These Terms govern access to Glacier, including the Discord bot, website, dashboard, marketplace, automation tools, forms, tickets and related services.

1. Acceptance

By inviting Glacier to a Discord server, logging into the dashboard, using commands or accessing any Glacier feature, you agree to these Terms. If you act for a Discord server, organization or team, you confirm that you have authority to bind that server or organization to these Terms.

2. Service Description

Glacier provides Discord bot modules, moderation tools, ticket systems, forms, automations, marketplace features, analytics, dashboard settings, premium/tester functionality and related utilities. Features may change, be rate-limited, disabled or removed when needed for security, reliability, compliance or product reasons.

3. Eligibility and Account Security

  • You must meet Discord's minimum age and eligibility requirements.
  • You must comply with Discord's Terms, Developer Policies and Community Guidelines.
  • You are responsible for your Discord account, dashboard sessions, permissions and actions performed through your account.
  • You must not share tokens, sessions, credentials or admin access with unauthorized people.

4. Server Administrator Responsibilities

  • Server administrators are responsible for selecting modules, configuring permissions and informing members about enabled features.
  • Administrators are responsible for moderation decisions, ticket handling, transcript settings, form collection, AI feature activation and retention choices made in their server.
  • Administrators must have a lawful basis for processing member data through Glacier and must not use Glacier to collect unlawful or unnecessary sensitive data.
  • If a server misuses Glacier, we may suspend features, block access, remove data or terminate service for that server.

5. Acceptable Use

  • Do not use Glacier for unlawful, harmful, fraudulent, abusive, harassing, discriminatory or privacy-invasive purposes.
  • Do not bypass rate limits, exploit bugs, attack infrastructure, scrape data or interfere with other users, servers or systems.
  • Do not upload malware, stolen content, illegal content, token grabbers, phishing material or content that violates Discord rules.
  • Do not impersonate Glacier, misrepresent official status or resell access without permission.
  • Do not use AI or automation features to generate illegal content, evade moderation, harass users or make high-impact automated decisions without human review.

6. Marketplace and User Content

You keep rights to content you submit, but you grant Glacier a worldwide, non-exclusive, royalty-free license to host, display, moderate, copy, adapt and distribute it as needed to operate the service.

We may review, hide, edit, reject or remove marketplace content, listings, reviews, reports and public profiles that violate these Terms, Discord rules, intellectual property rights or safety standards.

7. Premium, Tester and Paid Features

  • Premium or tester features may be provided through subscriptions, keys, promotions, referrals or manual grants.
  • Paid access does not guarantee uninterrupted availability of every feature.
  • Unless mandatory consumer law provides otherwise, refunds are handled case by case and may be denied for misuse, abuse, chargeback fraud or substantial use of the service.
  • We may change prices, limits or included features with reasonable notice where required by law.

8. Intellectual Property

Glacier software, branding, logos, designs, text, documentation and original content are owned by the Glacier operator or licensed to Glacier. No rights are transferred except the limited right to use the service according to these Terms.

9. Third-Party Services

Glacier depends on Discord, hosting providers, databases and optional AI providers. Third-party outages, API changes, policy changes or account restrictions may affect Glacier. Their own terms and policies apply to their services.

10. Suspension and Termination

  • We may suspend or terminate access if we believe there is abuse, legal risk, security risk, policy violation, non-payment or harm to Glacier, Discord, users or third parties.
  • You may stop using Glacier by removing the bot from your server and logging out of the dashboard.
  • Sections that by nature should survive termination, including intellectual property, liability, indemnity, governing law and data provisions, remain effective.

11. Availability and Warranties

Glacier is provided as available and as permitted by law. We do not promise uninterrupted, error-free or permanently available operation. Nothing in these Terms excludes statutory rights that cannot legally be excluded.

12. Liability

To the maximum extent permitted by law, Glacier is not liable for indirect damages, lost profits, lost data, lost Discord access, moderation decisions by server administrators, third-party outages or consequences of misconfiguration.

Nothing limits liability for intent, gross negligence, injury to life, body or health, fraudulently concealed defects or other liability that cannot legally be limited.

Where liability may legally be limited, total liability is limited to the amount paid for Glacier in the twelve months before the event giving rise to the claim or EUR 100, whichever is higher.

13. Indemnity

Where legally permitted, you agree to defend and indemnify Glacier against claims, damages, costs and expenses arising from your unlawful use, your server configuration, your user content, your breach of these Terms or your violation of third-party rights.

14. Changes

We may update these Terms when features, law, providers or risk requirements change. Material changes will be announced reasonably where possible. Continued use after changes become effective means acceptance of the updated Terms.

15. Governing Law and Disputes

German law applies, excluding conflict-of-law rules, unless mandatory consumer protection law gives you stronger rights. If you are a consumer, mandatory jurisdiction rules remain unaffected. The European Online Dispute Resolution platform was discontinued on July 20, 2025. Glacier is not willing or obliged to participate in consumer arbitration unless mandatory law requires it.
